Terms of Service

Welcome to FOCUS. These Terms of Service (the "Terms") govern your access to and use of the FOCUS websites, mobile applications, content, games, community features, AI-powered features, rewards, and other products or services that we own or operate (collectively, the "Services").

Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

These Terms form an agreement between you and FOCUS ("FOCUS," "we," "us," or "our"). Our Privacy Policy explains how we handle information, and our Community Guidelines describe rules for content and community participation. Additional rules may apply to particular games, campaigns, creator programs, referral programs, rewards, or other features. Those policies and feature-specific rules are incorporated into these Terms by reference.

If feature-specific rules conflict with these Terms, the feature-specific rules control for that feature to the extent of the conflict. Mandatory rights under applicable law continue to apply.

2. Eligibility

You must be at least 13 years old to use the Services. If you are at least 13 but have not reached the age of legal majority where you live, you may use the Services only with permission from a parent or legal guardian who agrees to these Terms on your behalf.

You may use the Services only if you are legally permitted to do so and have not been prohibited or suspended from using them. Certain features may be unavailable based on your location, device, account status, age, or other eligibility requirements.

3. User Accounts

Some features require an account. You agree to provide accurate information, keep it reasonably current, protect your device and credentials, and accept responsibility for activity conducted through your account. If you use a third-party sign-in provider, your use of that provider is also subject to its terms.

You must not sell, rent, transfer, or allow unauthorized access to your account. You must not create or use accounts to evade restrictions, manipulate rewards, misrepresent identity or location, or interfere with the Services. We may restrict accounts or features when multiple accounts or devices are used in a manner that indicates fraud, abuse, or an attempt to avoid our rules.

Please notify us promptly if you believe your account has been accessed without authorization. You may request account deletion through an available in-app control or by contacting us. Account deletion and data handling are described in our Privacy Policy.

4. License to Use the Services

Subject to these Terms, FOCUS grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for their intended purposes.

Except as expressly permitted by us or by applicable law, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, extract source code from, create derivative works from, or commercially exploit any part of the Services. Participation in a creator, reward, or other program offered by FOCUS does not violate this restriction when conducted in accordance with the applicable program rules.

5. User Content

The Services may allow you to create, upload, publish, send, store, or share text, images, videos, audio, comments, profile information, and other material. Material that you intentionally make available to other users or the public is "Public User Content." Information submitted privately to a feature, such as AI prompts, private messages, support requests, and unpublished drafts, is "Private Input." Together, Public User Content and Private Input are "User Content." You retain any ownership rights that you have in your User Content.

By submitting Public User Content, you grant FOCUS a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt, format, translate, publish, distribute, display, perform, and otherwise use that Public User Content as reasonably necessary to operate, provide, improve, secure, and promote the Services.

For Private Input, you grant FOCUS a limited license to host, store, reproduce, format, transmit, analyze, and otherwise process the Private Input only as reasonably necessary to provide, maintain, secure, and improve the feature you choose to use, comply with law, and enforce our policies. We will not make Private Input public except at your direction, as required to provide a feature you request, or as otherwise described in our Privacy Policy.

These licenses continue for as long as reasonably necessary for the relevant purpose and for a reasonable period afterward for backups, legal compliance, dispute resolution, security, and technical operations.

You represent that you own or have the necessary rights to submit your User Content and to grant this license, and that your User Content and our permitted use of it do not violate law, these Terms, or the rights of another person. You are responsible for your User Content and the consequences of making it available.

6. Public Content and Community Participation

Profile information, posts, comments, reactions, follows, Topics, Circles, rankings, and other community activity may be visible to other users or the public. Other people may view, copy, respond to, or share public User Content. Please choose carefully what you publish.

FOCUS does not endorse User Content and is not responsible for opinions, advice, offers, or other statements made by users. Interactions with other users are at your own discretion and risk.

7. Acceptable Use

You agree not to use the Services to:

  • Violate any law, regulation, contract, intellectual property right, privacy right, or other right;
  • Post or promote illegal, fraudulent, deceptive, threatening, abusive, hateful, sexually exploitative, or otherwise prohibited content;
  • Harass, impersonate, exploit, or endanger another person;
  • Distribute spam, malware, unauthorized advertising, or misleading links;
  • Scrape, crawl, automate, or access the Services in a manner not expressly authorized by FOCUS;
  • Bypass security, access controls, eligibility rules, rate limits, regional restrictions, or moderation actions;
  • Interfere with servers, networks, features, advertising, tasks, games, measurements, or other users;
  • Manipulate views, engagement, referrals, rankings, points, rewards, redemptions, or cashout results; or
  • Encourage, assist, or attempt any of the activities described above.

8. Content Review and Enforcement

We may, but are not required to, review, moderate, restrict, remove, label, preserve, or disclose User Content or activity when we reasonably believe it violates these Terms, our policies, feature rules, law, or the rights or safety of others.

We may limit distribution, disable features, withhold or reverse rewards, reject transactions, suspend accounts, or take other reasonable action. Automated systems and human review may be used to detect and evaluate content, security issues, fraud, or abuse. Enforcement decisions may take account of context, severity, frequency, risk, and available evidence.

If an appeal or reporting process is available, you may use it to ask us to review a decision. Availability of an appeal does not require us to restore content, access, or rewards.

9. Points, EXP, and Virtual Items

The Services may include points, EXP, balances, levels, access benefits, or other virtual items. These items are limited, revocable benefits within the Services. They are not legal tender, deposits, bank accounts, stored-value accounts, or guaranteed monetary value, and they do not give you an ownership interest in FOCUS.

Virtual items may be earned, granted, used, locked, adjusted, expired, limited, or revoked according to the applicable feature rules. They may not be sold, transferred, exchanged, or used outside the Services unless FOCUS expressly allows it. We may correct balances or records affected by errors, reversals, fraud, abuse, or invalid activity.

The availability, amount, frequency, and value of virtual items may vary by user, activity, market, device, campaign, advertising conditions, account status, and other factors. Receiving virtual items does not guarantee eligibility for redemption or cashout.

10. Rewards, Advertising, and Third-Party Tasks

Some activities may offer points or other benefits for viewing content, playing games, watching advertisements, opening reward features, completing tasks, responding to surveys, installing or using third-party applications, or taking other actions.

Reward availability and amounts are not guaranteed. They may depend on advertising inventory, third-party validation, first-time-user requirements, completion conditions, timing, market availability, technical reporting, account eligibility, and anti-abuse review. A third party's decision that an action was incomplete or invalid may affect whether a reward is credited.

Advertisements and third-party tasks may lead to products or services that FOCUS does not own or control. You are responsible for reviewing the third party's terms, privacy policy, costs, permissions, and requirements before participating.

11. Creator, Referral, and Campaign Programs

FOCUS may offer creator revenue sharing, viewer rewards, tips, referral benefits, invite rankings, promotional cashout opportunities, or other campaigns. Each program may have separate eligibility criteria, calculations, limits, schedules, and rules.

Program descriptions, in-app notices, and campaign rules determine the benefits available for a particular program. Percentages, examples, estimated earnings, rankings, and promotional amounts are illustrative unless the applicable rules expressly state otherwise. We may change, pause, cancel, recalculate, withhold, or recover program benefits where permitted by the applicable rules, including when activity is invalid, duplicated, manipulated, reversed, or affected by technical error.

You must not create false invitations, coordinate artificial engagement, misrepresent relationships, or use automated or misleading methods to obtain program benefits.

Unless applicable law or a specific written agreement states otherwise, participation in a creator, referral, or campaign program does not create an employment, agency, partnership, joint venture, franchise, or fiduciary relationship with FOCUS and does not authorize you to act or make commitments on behalf of FOCUS. You are responsible for determining and satisfying any tax, reporting, registration, or similar obligation that applies to benefits you receive. FOCUS or a payment provider may withhold or report amounts where required by law.

12. Redemption and Cashout

Redemption or cashout may be available only in supported markets and may depend on your physical location, local network, account status, balance, minimum or maximum amounts, available channels, payment-provider rules, identity or payee information, transaction history, and security or risk review.

You are responsible for providing complete and accurate payment-channel and payee information. A submitted request may not be editable. If information is inaccurate, a provider rejects the request, or another eligibility condition is not met, the request may be delayed, rejected, or returned according to the applicable status and rules.

FOCUS does not guarantee that every user can redeem virtual items, that every channel or amount will remain available, or that a request will be completed within a particular time. Fees, limits, exchange values, and processing conditions may be established by FOCUS or a third-party provider and may change.

13. Fraud and Abuse Prevention

We may use account, device, location, network, advertising, task, referral, transaction, and activity information to identify suspicious behavior. Prohibited conduct includes operating accounts at scale to obtain benefits, sharing or cycling devices to evade restrictions, falsifying location or identity, automating engagement, generating invalid advertising activity, and manipulating task, referral, creator, ranking, or cashout systems.

If we reasonably identify invalid or abusive activity, we may delay or deny a reward or transaction, correct balances, restrict particular amounts or features, require additional verification, suspend an account or device, or take other appropriate action. These measures may continue for a reasonable review or remediation period.

14. AI and Personalized Features

The Services may provide AI-generated characters, conversations, translations, summaries, recommendations, or other automated output. Such output may be incomplete, inaccurate, offensive, outdated, or unsuitable for your circumstances. It is provided for entertainment and general informational purposes and is not professional, legal, medical, financial, or other expert advice.

You are responsible for evaluating AI output before relying on, publishing, or acting on it. Do not use AI features to violate law, these Terms, or another person's rights, and avoid submitting information that you do not want processed as part of the feature.

Personalized feeds, suggestions, and rankings are generated using available signals and may change over time. We do not guarantee that recommendations will be accurate, complete, or suitable for you.

15. Third-Party Services

The Services may contain, display, integrate with, or link to third-party websites, games, applications, advertisements, sign-in providers, payment providers, offerwalls, surveys, content, or services. Your use of a third-party service is governed by that third party's terms and privacy practices.

FOCUS does not control and is not responsible for third-party content, availability, security, accuracy, products, charges, reward validation, or conduct. A link or integration does not imply endorsement. Any dispute between you and a third party is primarily between you and that third party, except where applicable law provides otherwise.

16. Intellectual Property

The Services, including their software, design, text, graphics, branding, logos, interfaces, databases, and FOCUS-provided content, are owned by or licensed to FOCUS and are protected by intellectual property and other laws. These Terms do not transfer ownership of the Services or FOCUS intellectual property to you.

If you provide suggestions, ideas, or other feedback about the Services, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use that feedback without restriction or compensation to you.

If you believe content on the Services infringes your rights, please contact us with sufficient information to identify the content and evaluate your request.

17. Privacy

Our Privacy Policy describes how we collect, use, disclose, retain, and protect information. By using the Services, you acknowledge the information practices described in the Privacy Policy.

18. Service Changes and Availability

We may add, change, suspend, limit, or discontinue any part of the Services, including features, content, virtual items, reward opportunities, eligibility rules, or supported markets. We may also release updates, require a supported app version, or perform maintenance.

The Services may be unavailable, delayed, or affected by network conditions, device compatibility, third-party services, maintenance, security incidents, or events beyond our reasonable control. We do not guarantee uninterrupted or error-free operation.

19. Suspension and Termination

You may stop using the Services at any time and may request account deletion as described in our Privacy Policy.

We may restrict, suspend, or terminate access to some or all of the Services if we reasonably believe that you violated these Terms or related rules; created legal, security, fraud, or safety risk; failed to satisfy eligibility requirements; or if suspension is reasonably necessary to protect the Services, users, or third parties.

Upon termination, the license granted to you under these Terms ends. Provisions that by their nature should survive termination will remain in effect, including provisions concerning User Content licenses, intellectual property, virtual items, disclaimers, liability, indemnity, disputes, and general terms.

20. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available." FOCUS disclaims all warranties and conditions, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment.

We do not warrant that the Services, content, AI output, games, advertisements, tasks, rewards, third-party services, or transactions will be uninterrupted, error-free, secure, accurate, available, or suitable for your needs. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

21. Limitation of Liability

To the maximum extent permitted by applicable law, FOCUS and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, opportunities, virtual items, or other intangible losses arising from or related to the Services or these Terms.

To the maximum extent permitted by applicable law, the total liability of FOCUS and the parties described above for all claims arising from or related to the Services or these Terms will not exceed the amount you paid directly to FOCUS for the Services during the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted by law.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.

22. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless FOCUS and its affiliates, officers, employees, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your User Content, your misuse of the Services, your violation of these Terms or related rules, or your violation of another person's rights.

23. Changes to These Terms

We may revise these Terms from time to time to reflect changes to the Services, our practices, or applicable requirements. If we make material changes, we may provide notice through the Services, by email, or by another reasonable method. The "Last Updated" date at the end of these Terms indicates when they were most recently revised.

Your continued use of the Services after revised Terms become effective means that you accept the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

24. Governing Law and Disputes

These Terms are governed by the laws applicable to the operator of the Services, without regard to conflict-of-law principles, except to the extent that mandatory law in your place of residence applies. Any dispute arising from or relating to the Services or these Terms will be submitted to a court with competent jurisdiction unless applicable law requires another process.

Before starting formal proceedings, you and FOCUS are encouraged to contact the other party and make a reasonable effort to resolve the dispute informally. Nothing in these Terms limits any non-waivable consumer right or remedy.

25. General Terms

These Terms and the policies incorporated by reference form the entire agreement between you and FOCUS regarding the Services. If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a reorganization, merger, acquisition, transfer of assets, or operation of the Services.

FOCUS is not responsible for delay or failure caused by events beyond its reasonable control. Section titles are provided for convenience and do not affect interpretation.
